Appeals

If you are the owner of the property or the person liable to pay Council Tax on it, and you believe that the wrong band has been applied to your property, you can lodge an appeal (known as a proposal) to alter the Council Tax band:

  • within six months of first becoming a taxpayer in respect of the dwelling.
  • within six months of receipt of a Notice of Banding where the Assessor has amended a band.
  • within six months of an appeal decision of the First-tier Tribunal for Scotland, which is a relevant decision, in respect of a dwelling comparable to yours which gives you reasonable grounds to contend that the band of your dwelling should also be changed.
  • at any time if you believe there has been a “material reduction” in the value of the dwelling.
  • at any time if you believe there has been a “material increase” in the value of the dwelling and it, or any part of it, has subsequently been sold.
  • at any time if the balance between domestic and non-domestic use changes (for example, in guest houses or hotels).
  • at any time to add a dwelling not shown on the list.
  • at any time to delete a dwelling that is shown on the list.
  • at any time to delete a dwelling that was shown on the list.

If you wish to make a proposal, and one of the above applies, you can submit a proposal online via the Scottish Assessors' portal at www.saa.gov.uk , by submitting an email to appealsandwithdrawals@lanarkshire-vjb.gov.uk or alternatively, you can write to us, at the address shown below, including the following information:

  • your name and address and in what capacity (Owner, liable person) you are making the proposal.
  • the address of the property to which the proposal relates.
  • the change to the Valuation List that you are proposing and the date from which the change should be effective.
  • statement of why you believe the list should be altered.
  • (Where relevant) details of any relevant appeal decision (as outlined above) which gives rise to the proposal.
